Fiji Your Way Host Agreement

1. Independent Contractor Status

Hosts operate as independent businesses, contractors, or service providers. You are not an employee, agent, joint venturer, or partner of Fiji Your Way ("Platform"). The Platform acts exclusively as a technology marketplace to connect you with Users.

2. Anti-Circumvention and Off-Platform Transactions

The Platform relies on booking fees to operate. Hosts agree not to encourage, request, or allow Users to bypass the Platform for the purpose of avoiding booking fees. Hosts may not include personal contact information, phone numbers, WhatsApp numbers, emails, websites, payment links, or other direct contact details in public listing descriptions. Attempts to circumvent the Platform for initial bookings may result in account suspension, listing removal, booking cancellation, or permanent removal from the Platform.

3. Listing Accuracy and Platform Rights

Hosts must ensure all listings feature accurate descriptions, photos, locations, availability, prices, included services, restrictions, and fees. Hosts must not overstate amenities, hide material conditions, use bait-and-switch pricing, or surprise Users with undisclosed charges. The Platform reserves the right to edit, modify, hide, or remove listing content, including contact information or inappropriate text, to maintain marketplace standards.

4. Service Responsibility and Safety

Hosts are solely responsible for the delivery, safety, legality, quality, and suitability of their services. Hosts must ensure that all vehicles, properties, tours, transfers, equipment, drivers, guides, and staff are safe, maintained, fit for their advertised purpose, and compliant with applicable laws and standards.

5. Legal and Regulatory Compliance

Hosts represent and warrant that they possess all necessary licenses, permits, registrations, approvals, and insurance required by the laws of the Republic of Fiji or other applicable jurisdictions to operate their specific business, including commercial vehicle registration, accommodation permits, tour operator licenses, transport permits, and tax registrations where required.

6. Fees and Payment Collection

The Platform collects a booking fee from the User at the time of reservation or checkout as shown to the User. The Host is solely responsible for collecting the remaining rental or service balance, security deposits, and any disclosed local fees directly from the User according to the listing's payment terms.

7. Taxes

Hosts are solely responsible for determining, collecting, reporting, and remitting any applicable local taxes, income taxes, VAT, tourism taxes, or other taxes to the Fiji Revenue and Customs Service (FRCS) or any other applicable tax authority arising from payments they collect.

8. Availability, Commitment, and Cancellations

Hosts must keep availability accurate and honor confirmed bookings. Canceling a confirmed booking causes serious disruption to Users and may harm the reputation of the Host, the Platform, and Fiji hospitality. Frequent, unjustified, or last-minute Host cancellations may result in lower search visibility, account review, temporary suspension, or removal from the Platform.

Platform visibility may be influenced by User reviews, service quality, responsiveness, cancellations, safety reports, and marketplace integrity signals. Hosts acknowledge that Users may leave public ratings and reviews based on real experiences. Reviews must not be fake, misleading, coerced, retaliatory, or conditioned on incentives. Consistently poor ratings, unresolved complaints, fake review activity, or safety reports may lead to moderation, reduced visibility, suspension, or removal from the marketplace.

11. Insurance Requirements

The Platform provides no insurance coverage for Hosts or Users. Hosts are required to maintain appropriate, up-to-date insurance for their specific services, including commercial vehicle insurance, property liability insurance, public liability insurance, tour operator insurance, or other coverage required by law or prudent business practice.

12. Indemnification

Hosts agree to defend, indemnify, and hold harmless Fiji Your Way, its founders, operators, employees, contractors, and affiliates from any claims, damages, liabilities, losses, costs, or legal fees arising directly or indirectly from the Host's services, property, vehicles, staff, conduct, content, legal compliance, insurance gaps, taxes, disputes, or breach of this Agreement.

13. Liability for Damages and Legal Action

Hosts acknowledge that intentional, reckless, negligent, fraudulent, unsafe, or unlawful conduct causing physical, financial, reputational, or legal harm to a User, another Host, or the Platform may result in account action and civil or criminal legal action. The Platform and affected parties reserve the right to pursue available legal remedies to the fullest extent permitted by law.

14. Deposits and External Payments

Hosts may request deposits or additional payments directly from Users using third-party payment providers or offline methods only if clearly disclosed before booking. The Platform does not process, collect, store, verify, guarantee, or manage such payments. Hosts acknowledge and agree that these transactions are conducted solely between the User and the Host.

The Platform does not guarantee, verify, or assume responsibility for deposit payments, refunds, payment disputes, fraud, chargebacks, external payment links, or offline cash transactions.

Security Warning: Hosts should not request sensitive financial information through Platform messaging and should clearly disclose all deposit and payment requirements before booking.

By registering as a Host on Fiji Your Way, you acknowledge that you have read, understood, and agree to be bound by this Host Agreement, and agree to accept future updated versions.
