This Partner Agreement applies to users who sign up for the Fiji Your Way referral or affiliate program ("Partners"). Partners are independent contractors and are not employees, agents, joint venturers, franchisees, or legal representatives of Fiji Your Way. Partners have no authority to bind Fiji Your Way, promise refunds, approve bookings, make service guarantees, or speak on behalf of the Platform.
During the launch period, eligible Partners may earn a referral commission equal to 10% of the Net Booking Fee for qualifying completed bookings attributed to their approved referral code, referral link, or a referral manually approved by Fiji Your Way. Host or owner referrals are eligible for the first 12 months after the referred host signs up or is matched to the Partner in Platform records. Traveler referrals may remain eligible while the Partner program is active, subject to this Agreement and Fiji Your Way's attribution rules.
Fiji Your Way may change, pause, or end the launch offer at any time for future referrals. Commissions already approved will not be reduced except for errors, fraud, refund, chargeback, payment failure, duplicate attribution, or other adjustment allowed by this Agreement.
For this Agreement, the "Booking Fee" means the platform booking fee charged by Fiji Your Way at checkout. The Booking Fee is calculated as a percentage of the Fiji dollar rental or service price. For example, a 14-day car rental at FJD $125/day totals FJD $1,750. If the booking fee is 5%, the checkout booking fee is $87.50.
Referral commissions are calculated from the Net Booking Fee base. In the example above, a 10% referral commission on the $87.50 booking fee base is $8.75 before final deductions. This is a sample of what a Partner can earn: 100 similar monthly rentals would bring in $875 before final deductions. More bookings can create more commission earnings.
The "Net Booking Fee" means the Booking Fee retained by Fiji Your Way after deductions, including payment processor fees, Stripe fees, card network fees, currency conversion or foreign exchange fees, taxes, VAT, discounts, refunds, chargebacks, disputes, reversals, credits, rounding adjustments, and other transaction costs. Dashboard balances, emails, and reports may show estimated or gross amounts until Fiji Your Way completes payout review.
Referral commissions are calculated only from the Net Booking Fee, not from the total rental price, service price, host payout, security deposit, taxes, offline payments, delivery fees, insurance charges, damage claims, or any amount collected directly by a host or third party.
A commission is eligible only when a referred user or host is properly attributed to the Partner in Platform records, the booking is paid through the Platform, the booking is completed or otherwise approved by Fiji Your Way, and no refund, chargeback, fraud, abuse, duplicate referral, or policy violation applies. Fiji Your Way records control referral attribution and commission calculations.
Only one referral commission is payable for any single booking. If both the traveler and the host are attributed to referral partners for the same booking, the traveler referral takes priority and the host referral does not earn an additional commission for that booking. Fiji Your Way may choose a different attribution result in cases of error, abuse, duplicate attribution, manual adjustment, or special written approval.
Self-referrals, duplicate accounts, fake accounts, family or business accounts created mainly to generate commissions, referral stuffing, coupon abuse, misleading promotions, paid search ads bidding on Fiji Your Way brand names, spam, scraped contact lists, and any deceptive or unlawful marketing are prohibited.
Approved referral balances are reviewed monthly. Fiji Your Way will attempt to pay eligible Partners monthly only when the Partner's approved unpaid balance reaches at least FJD $100 or the equivalent amount in the payout currency. Balances below FJD $100 roll over to a future month. Payouts are reduced by applicable bank transfer fees, international wire fees, payout provider fees, currency conversion fees, withholding, deductions, or other charges connected to sending the payment.
Partners must provide accurate payout details and any requested identity, tax, or compliance information. Fiji Your Way may delay or withhold payout where information is missing, inaccurate, suspicious, legally restricted, or under review.
Commission reports, dashboard balances, emails, and payout estimates may contain errors or delays. Fiji Your Way may correct calculation errors, duplicate credits, attribution mistakes, currency conversion mistakes, software bugs, payment processor data issues, or manual entry mistakes at any time. If a commission was overpaid, Fiji Your Way may offset the overpayment against future commissions or request repayment.
Commissions are not final until the related booking is no longer subject to normal refund, chargeback, fraud, or dispute risk as determined by Fiji Your Way. If a booking is refunded, canceled, disputed, reversed, charged back, determined fraudulent, or adjusted, any related commission may be canceled, reduced, withheld, or clawed back.
Partners must market Fiji Your Way honestly and lawfully. Partners may not make false claims about pricing, availability, refunds, safety, host quality, insurance, guaranteed earnings, or Fiji Your Way approval. Partners may not use Fiji Your Way trademarks, logos, photos, listing content, or brand assets except as approved by Fiji Your Way. Partners are responsible for complying with advertising, privacy, email, SMS, social media, tax, and consumer protection laws that apply to their marketing activity.
Partners are solely responsible for determining, reporting, and paying all taxes, duties, registrations, licenses, or filings arising from referral commissions or Partner activities. Fiji Your Way may request tax forms or withhold amounts where required by law.
Fiji Your Way does not guarantee that any Partner will earn commissions, receive traffic, generate bookings, maintain a referral rate, or receive any minimum payout. Referral opportunities depend on marketplace activity, customer behavior, availability, attribution, and Platform policies.
Fiji Your Way may suspend or terminate Partner participation, withhold unpaid commissions, remove referral codes, or close accounts for fraud, abuse, suspicious activity, policy violations, unlawful conduct, reputational harm, chargeback risk, inaccurate information, or any conduct that harms the Platform, users, hosts, or marketplace integrity.
To the fullest extent permitted by law, Fiji Your Way is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost referrals, lost data, business interruption, payment delays, Platform downtime, exchange rate changes, or third-party payment and banking issues. Fiji Your Way's total liability for Partner-related claims will not exceed the unpaid approved commissions owed to the Partner for the three months before the event giving rise to the claim.
Partners agree to defend, indemnify, and hold harmless Fiji Your Way, its founders, operators, employees, contractors, and affiliates from any claims, damages, liabilities, losses, costs, or legal fees arising from the Partner's marketing, referrals, statements, content, taxes, payout details, legal compliance, misconduct, fraud, or breach of this Agreement.
Fiji Your Way may update this Agreement from time to time by posting an updated version on the Platform or providing notice through reasonable means. Continued participation in the Partner program after an update means the Partner accepts the updated terms.
This Agreement is governed by the laws of the State of California, USA, without regard to conflict of law principles, except where applicable law requires otherwise.
By registering as a Fiji Your Way Partner, you acknowledge that you have read, understood, and agree to this Partner Agreement, the Terms of Service, and the Privacy Policy.
