Fiji Your Way Terms of Service

1. Platform Role

Fiji Your Way ("Platform") is an independent marketplace technology provider that connects renters, travelers, and guests ("Users") with independent hosts, drivers, property owners, tour operators, and service providers ("Hosts"). The Platform is not a provider of rental cars, accommodations, transfers, tours, or other listed services, and does not own, operate, inspect, manage, or control any listed service. All bookings form a legally binding agreement directly between the User and the Host.

2. Booking Process

Users may submit booking requests through the Platform. A booking is not confirmed until accepted by the Host. Upon confirmation, a binding agreement is formed exclusively between the User and the Host.

3. Fees and Payments

The Platform charges a booking fee plus applicable taxes as shown at checkout. Booking fees may vary by service type, listing, promotion, custom fee setting, or platform configuration. Unless otherwise stated at checkout or required by law, the Platform booking fee becomes non-refundable after Host acceptance. The remaining balance for the rental or service is paid directly to the Host. The Platform does not collect, hold, or manage final rental payments, security deposits, or other offline payments between Users and Hosts.

4. Anti-Circumvention

Users and Hosts agree to use the Platform to communicate and book services. Attempting to bypass the Platform to avoid booking fees, including sharing direct contact information before a booking is confirmed, is strictly prohibited and may result in account suspension, termination, listing removal, booking cancellation, or other enforcement action.

5. Cancellations

• Before Host acceptance: Users may cancel a pending booking request before Host acceptance.
• After confirmation: Unless otherwise stated at checkout or required by law, the Platform booking fee is non-refundable. Refunds for the remaining rental or service balance are governed exclusively by the individual Host's cancellation policy.

6. No-Show Policy

If a User fails to appear for a booked service after Host confirmation, the Platform booking fee remains non-refundable unless otherwise required by law. A no-show may also be subject to the Host's disclosed policies regarding the remaining rental or service amount.

7. User Responsibilities

Users agree to:

• Provide accurate identity, contact, booking, and payment information.
• Review all listing details, Host rules, payment terms, cancellation policies, insurance terms, and deposit requirements before booking.
• Comply with all applicable laws, including local Fiji laws and travel requirements.
• Respect Host rules, policies, property, vehicles, staff, and other guests.
• Hold and present valid licenses and documentation where required, including for vehicle rentals.

8. Host Responsibilities

Hosts agree to:

• Provide accurate, up-to-date listings, photos, descriptions, prices, availability, policies, and fees.
• Deliver services as described in the listing and confirmed booking.
• Maintain all required licenses, permits, registrations, insurance, safety standards, and legal compliance.
• Disclose security deposits, payment methods, cancellation policies, and material restrictions before booking.
• Resolve service-related issues, damage claims, refunds outside the Platform booking fee, and disputes directly with Users.

9. Mutual Due Diligence

While the Platform may conduct basic verification for certain accounts, we do not conduct comprehensive background checks on all Users or Hosts, and we do not physically inspect listed inventory. Both parties must exercise their own due diligence.

• Host Due Diligence: Hosts are responsible for verifying the physical identity of Users upon arrival, checking required documents such as driver's licenses or passports, and determining whether a User is suitable before granting access to a vehicle, property, tour, transfer, or service.
• User Due Diligence: Users are responsible for reviewing listing details, Host rules, and cancellation policies before booking. Upon arrival, Users should inspect vehicles, properties, or services and document any pre-existing damage or concerns with the Host before accepting handover.

10. Liability and Insurance Disclaimer

The Platform acts solely as a booking facilitator and provides no insurance coverage of any kind. To the fullest extent permitted by law, the Platform is not liable for:

• Personal injury, illness, death, accident, loss, theft, or property damage.
• Fraud, misconduct, misrepresentation, negligence, or service failure by any User or Host.
• The condition, safety, legality, quality, availability, or suitability of vehicles, properties, tours, transfers, or other services.
• Deposits, offline payments, refunds, chargebacks, payment disputes, or external payment links handled directly between Users and Hosts.

11. Disputes and Indemnification

Any disputes regarding the rental or service are strictly between the User and the Host. The Platform may offer customer support or informal mediation, but is not responsible for the outcome. Users and Hosts agree to defend, indemnify, and hold harmless Fiji Your Way, its founders, operators, employees, contractors, and affiliates from any claims, damages, liabilities, losses, costs, or legal fees arising from their use of the Platform, booked services, conduct, content, or breach of these Terms.

12. Taxes

The Platform collects and remits taxes only where it is legally required to do so for its own fees. Hosts are solely responsible for determining, calculating, collecting, reporting, and remitting all applicable local taxes, income taxes, VAT, tourism taxes, or other charges on the amounts they receive directly from Users.

13. Reviews and User Content

Reviews, ratings, messages, listing descriptions, photos, and other content submitted through the Platform must be honest, lawful, and based on real experiences. Users and Hosts may not submit fake, misleading, abusive, discriminatory, defamatory, or manipulated content, and may not offer incentives conditioned on positive reviews. The Platform may moderate, hide, remove, or restrict content that violates these Terms, appears fraudulent, or creates safety, legal, or marketplace integrity concerns.

14. Termination

The Platform reserves the right to suspend, restrict, or terminate accounts or listings for fraud, misconduct, safety violations, attempts to bypass platform fees, unlawful conduct, repeated cancellations, poor reviews, unresolved complaints, or other behavior that harms Users, Hosts, or marketplace integrity.

15. Governing Law and Jurisdiction

These Terms of Service, as they relate to use of the Platform technology, are governed by the laws of the State of California, USA. The separate rental or service agreement formed between the User and the Host may be governed by the laws of the Republic of Fiji or other applicable local laws depending on the service location and parties involved.

16. Deposits and External Payments

Hosts may request security deposits or additional payments directly from Users using third-party payment providers or offline methods only if those amounts and methods were clearly disclosed before booking. The Platform does not process, collect, store, verify, guarantee, or manage such payments. Users acknowledge that these transactions are conducted solely between the User and the Host.

The Platform does not guarantee, verify, or assume responsibility for deposit payments, refunds, payment disputes, fraud, chargebacks, external payment links, or offline cash transactions.

17. Trademark and Affiliation Disclaimer

Fiji Your Way is an independent Fiji travel marketplace. Fiji Your Way is not affiliated with, endorsed by, sponsored by, operated by, or connected to Fiji Airways, FIJI Water, Tourism Fiji, the Government of Fiji, or any other airline, bottled water company, tourism board, government agency, hotel, rental company, travel provider, third-party brand, company, or agency unless expressly stated by Fiji Your Way in writing.

All third-party names, logos, brands, service marks, and trademarks belong to their respective owners. Any reference to a third-party name or location is used only for identification, descriptive, informational, or travel-planning purposes and does not imply endorsement, sponsorship, partnership, approval, or control by that third party.
